These Terms of Use (“Terms”) govern your access to and use of the CRESAL website and services (the “Services”). By using the Services, you agree to these Terms.
1) Eligibility
- You must be at least 18 years old and legally able to enter into contracts.
- You are solely responsible for ensuring your use complies with the laws of your jurisdiction. We may geo-block or restrict access without notice.
2) Wallets & Blockchain
- You connect a self-custody wallet to interact with Solana smart contracts. You are responsible for your wallet, private keys, seed phrase, and device security.
- Transactions you authorize are irreversible and recorded publicly on-chain. Network fees apply and are not refundable.
3) Raffles & NFTs
- Purchases are entries to draws; you also receive an NFT receipt.
- No guarantee of winning. Odds are determined by total number of entries.
- We may publish winning wallet addresses and prize announcements on-chain or on our site.
- We may cancel or postpone a draw due to technical, legal, or security issues; in such cases we will communicate next steps and applicable remedies (if any) at our discretion and subject to law.
4) Prohibited Uses
- Illegal activity, fraud, market manipulation, money laundering, or sanctions violations.
- Interference with the site, smart contracts, or other users.
- Using bots/scrapers that degrade service or bypass controls.
5) No Financial or Investment Advice
Our Services are for entertainment only. We do not provide investment, legal, or tax advice. Do your own research.
6) Fees, Taxes & Refunds
- Network fees are paid by you and are non-refundable.
- Unless required by law, all purchases are final.
- You are responsible for any applicable taxes.
7) Third Parties
We rely on third-party wallets, RPC providers, and analytics. We are not responsible for outages or actions of third-party services.
8) Disclaimer of Warranties
Services are provided “as is” and “as available” without warranties of any kind, to the maximum extent permitted by law.
9) Limitation of Liability
To the fullest extent permitted by law, in no event will we be liable for indirect, incidental, special, consequential, or exemplary damages, or for lost profits, data, or goodwill. Our aggregate liability will not exceed the amount you paid to us for the applicable transaction during the 12 months before the event giving rise to the claim.
10) Indemnity
You agree to indemnify and hold us harmless from claims arising out of your use of the Services, violation of these Terms, or infringement of third-party rights.
11) Changes; Suspension
We may modify or suspend the Services (including draws) at any time. We may update these Terms from time to time; continued use means you accept the changes.
12) Governing Law & Disputes
These Terms are governed by the laws of St. Vincent and the Grenadines, without regard to conflicts of law principles. Disputes will be resolved exclusively in the courts/arbitration forum of Kingstown, St. Vincent and the Grenadines. You waive any objection to venue or jurisdiction there.
